City of South Beloit City Council met July 1.

Here is the minutes provided by the council:

CALL TO ORDER: 5:00 pm, Council Chambers, City Hall by Mayor Rehl.

ROLL CALL: Present & answering to roll call were Commissioners Duffy, Hedrington, Morse, Mayor  Rehl. Commissioner Fitzgerald was absent

City Attorney Aaron Szeto was present

Deputy Clerk Karen Brandenburg recorded the minutes

PLEDGE OF ALLEGIANCE: Led by Mayor Rehl and recited by all members present.

INVOCATION: Mayor Rehl asked for a moment of silence.

APPROVE AGENDA:

Commissioner Hedrington made a motion to approve the agenda second by Commissioner Duffy. Voice vote carried the motion.

PUBLIC COMMENT:

None.

APPROVAL OF MINUTES:

1. Commissioner Morse made a motion to approve the minutes of the Regular Council Meeting held on June 17, 2019. Commissioner Duffy second the motion. Voice vote carried the motion.

2. Commissioner Hedrington made a motion to approve the minutes of the Public Hearing Meeting held on June 17, 2019. Commissioner Morse second the motion. Voice vote carried the motion.

REPORT OF OFFICERS:

1. Finance:

Commissioner Morse made a motion to approve the claims to be paid from June 15-28, 2019 in the amount of $1,024,681.20. Commissioner Hedrington second the motion. Roll call vote showed 4 ayes and 1 absent by Commissioner Fitzgerald.

2. Attorney Report:

City Attorney, Aaron Szeto wanted to give an update on the Facade Grant Program the Mayor wants to do for improvements on Gardner Street. Attorney Szeto stated he is verifying that the funds can be used for public purpose and let the board know at the next council meeting.

3. Commissioner’s Report:

1. Discussion and/or Motion Items:

a. Commissioner Duffy made a motion to approve the request for a block party on Rood Avenue to be held on August 10, 2019 from noon until 5 pm from Church of Christ.

Commissioner Morse second the motion. Voice vote carried the motion.

b. From the Zoning Board of Appeals Meeting held on June 19, 2019 a positive recommendation was given regarding a Zoning Map Amendment. Commissioner Duffy made a motion to approve Ordinance 2435 approving a Zoning Map Amendment from the (IL) Light Industrial Zoning District to the (CG) Commercial General Zoning District for the property located at 1403 Pate Plaza, South Beloit, Illinois, Winnebago County, with PIN No. 04-04-100-002. From petitioner Prayog, LLC. Commissioner Morse second the motion. Roll call vote showed 4 ayes and 1 absent by Commissioner Fitzgerald.

c. From the Zoning Board of Appeals Meeting held on June 19, 2019 a positive recommendation was given regarding a Zoning Map Amendment.

Commissioner Hedrington made a motion to approve Ordinance 2436 approving a Zoning Map Amendment from the (CR) Commercial Retail Zoning District to the (CG) Commercial General Zoning District for the property commonly known as 1240 Blackhawk Blvd., South Beloit, Illinois, Winnebago County, with PIN No.’s 04-07- 231-013, 04-07-231-014, and 04-07-231-015. From petitioner Jim Butitta. Commissioner Duffy second the motion. Roll call vote showed 4 ayes and 1 absent by Commissioner Fitzgerald.

d. From the Zoning Board of Appeals Meeting held on June 19, 2019 a positive recommendation was given regarding a Zoning Variance. Commissioner Morse made a motion to approve Ordinance 2437 approving a Zoning Variance in the side yard setback from the required 10’ down to 8’ to allow for an accessory pool in the (RR) Rural Residential Zoning District for the property located at 13834 Chevron Drive, South Beloit, Illinois, Winnebago County, with PIN No. 04-18-403-025. Filed by Marianna Bilardello. Commissioner Hedrington second the motion. Roll call vote showed 4 ayes and 1 absent by Commissioner Fitzgerald.

e. From the Zoning Board of Appeals Meeting held on June 19, 2019 a positive recommendation was given regarding a Zoning Variance. Commissioner Duffy made a motion to approve Ordinance 2438 approving a Zoning Variance in the front yard setback from the required 20’ down to 0’ for an 8’ high fence in the (IL) Light Industrial Zoning District for the property located at 400 Clark Street, South Beloit, Illinois, Winnebago County with PIN No’s 04-05-307-001. Filed by Eric Zingre. Commissioner Hedrington second the motion. Roll call vote showed 4 ayes and 1 absent by Commissioner Fitzgerald.

f. From the Zoning Board of Appeals Meeting held on June 19, 2019 a positive recommendation was given regarding a Zoning Variance. Commissioner Duffy made a motion to approve Ordinance 2439 approving a Zoning Variance for parking space length from the required 18’ down to 17’ and a Zoning variance for a drive isle width from the required 24’ down to 22’ in the (CR) Commercial Retail Zoning District for the property located at 1655 Blackhawk Blvd, South Beloit, Illinois, Winnebago County, with PIN No.’s 04-07-402-001 and 04-07-402-003. Filed by R. H. Batterman & Co. Inc. Commissioner Morse second the motion. Roll call vote showed 4 ayes and 1 absent by Commissioner Fitzgerald.

g. From the Zoning Board of Appeals Meeting held on June 19, 2019 a positive recommendation was given regarding a Special Use Permit. Commissioner Hedrington made a motion to approve Ordinance 2440 approving a Special Use Permit to allow secondhand sales of vintage and antique merchandise in the (CG) Commercial General Zoning District for the property located at 1019 Gardner Street, South Beloit, Illinois, Winnebago County, with PIN No. 04-05-276-002. Filed by Vicki Bryden. Commissioner Duffy second the motion. Roll call vote showed 4 ayes and 1 absent by Commissioner Fitzgerald.

h. From the Zoning Board of Appeals Meeting held on June 19, 2019 a positive recommendation was given regarding a Special Use Permit. Commissioner Duffy made a motion to approve Ordinance 2441 approving a Special Use Permit to allow for storage building for household goods which is a permitted use in the (CG) Commercial General Zoning District in the (IL) Light Industrial Zoning District for the property located at 850 Doner Drive, South Beloit, Illinois, Winnebago County, with PIN No.’s 04-06-476-006 and 04-06-476-007. Filed by Amerco Real Estate Co. Commissioner Hedrington second the motion. Roll call vote showed 4 ayes and 1 absent by Commissioner Fitzgerald.

i. From the Zoning Board of Appeals Meeting held on June 19, 2019 a positive recommendation was given regarding a Special Use Permit. Commissioner Hedrington made a motion to approve Ordinance 2442 approving a Special Use Permit to allow open sales lot in the (CG) Commercial General Zoning District for the property located at 14339 Willowbrook Road, South Beloit, Illinois, Winnebago County, with PIN No. 04-15-100-014. Filed by Prestige Storage, LLC. Commissioner Morse second the motion. Roll call vote showed 4 ayes and 1 absent by Commissioner Fitzgerald.

j. From the Zoning Board of Appeals Meeting held on June 19, 2019 a positive recommendation was given regarding the Tentative and Final Plat’s. Commissioner Morse made a motion to approve Resolution 6053 approving the Tentative and Final Plats of Gardner’s Subdivision for the property located at 2xx Gardner Street, South Beloit, Illinois, Winnebago County, with PIN No. 04-05-179-002. Filed by City of South Beloit. Commissioner Duffy second the motion. Roll call vote showed 4 ayes and 1 absent by Commissioner Fitzgerald.

k. Commissioner Hedrington made a motion to approve Ordinance 2443 amending Chapter 62-Offences and Miscellaneous Provisions of the City Code of Ordinances to create a new Section 62-55 to require Sex Offenders to register within the City and pay Registration Fees and to create a new Section 62-56 to require Murders and Violent Offenders Against Youth to register with the City and to pay Registration Fees. Chief Truman stated the City currently has 24 Sex Offenders that reside in South Beloit. The current fee is $5.00 and that’s if they pay. This Ordinance will make it mandatory to pay the $30.00 initial fee, then $20.00 annually. Commissioner Duffy second the motion. Roll call vote showed 4 ayes and 1 absent by Commissioner Fitzgerald.

l. Commissioner Duffy made a motion to lay over Ordinance 2444 Reducing the Speed Limit in Residential Areas to 25 miles Per Hour. Commissioner Morse second the motion. Voice vote carried the motion.

m. Commissioner Hedrington made a motion to approve Resolution 6054 approving an Agreement with Police Sergeants. Commissioner Duffy second the motion. Roll call vote showed 4 ayes and 1 absent by Commissioner Fitzgerald.

n. Commissioner Hedrington made a motion to approve Resolution 6055 approving a Memorandum of Understanding with the Fraternal Order of Police for shift trace and Contract clarification. Commissioner Duffy second the motion. Roll call vote showed 4 ayes and 1 absent by Commissioner Fitzgerald.

o. Commissioner Duffy made a motion to approve Resolution 6056 approving a Settlement Agreement with the Estate of Earnest Heard regarding 1921 Spencer Court. Commissioner Morse second the motion. Roll call vote showed 4 ayes and 1 absent by Commissioner Fitzgerald.

p. Commissioner Morse made a motion to lay over Resolution 6057 approving and authorizing the purchase of Decorative Planters from T2 Site Amenities at an amount not to exceed $13,923.00. Commissioner Hedrington second the motion. Voice vote carried the motion.

q. Commissioner Morse made a motion to lay over Resolution 6058 approving and authorizing the purchase of Waste Receptacles and Benches from Kirby Built Sales at a cost not to exceed $11,151.46. Commissioner Hedrington second the motion. Voice vote carried the motion.

Commissioner Duffy made a motion to approve all licenses second by Commissioner Hedrington. Voice vote carried the motion.

EXECUTIVE SESSION:

At 5:36 pm on a motion made by Commissioner Morse second by Commissioner Duffy. Voice vote carried the motion. The purpose for Executive Session is to:

1. Discuss personnel issues as provided by 5 ILCS 120/2 (c) (1) of the Illinois Open Meetings Act.

RECONVENE TO OPEN SESSION: At 5:46 pm.

ROLL CALL: Roll call showed all members present at the onset of the meeting.

ADJOURN: At 5:47 pm on a motion made by Commissioner Hedrington second by Commissioner Duffy. Voice vote carried the motion.
