I. CALL TO ORDER

Legal Director Nicholas Meyer called the meeting to order at 5:35 p.m.

Alderman Frost moved to nominate Alderman Logemann to serve as Mayor Pro Tem for this meeting. Alderman Thompson-Kelly seconded the motion. MOTION PREVAILED with a unanimous roll call vote (Aldermen Hoffman and McNeely were absent).

Aldermen Hervey and Beach appeared via teleconference.

Alderman Beach moved to accept the Journal of Proceedings for the Special City Council meeting held on August 31, 2020, seconded by Alderman Rose. MOTION PREVAILED with a unanimous roll call vote (Aldermen Hoffman and McNeely were absent).

2. Journal of Proceedings for the Strategic Planning Session held on August 31, 2020.

1. Memorandum from Jennifer Jaeger, Community Services Director, regarding the request for a resolution to accept the Second Allocation of Supplemental funding to the HUD Emergency Solutions Grant through the Coronavirus Aid, Relief and Economic Security Act. Referred to Planning and Development Committee.

B. Code and Regulation Committee

1. Traffic Commission Agenda for the meeting to be held on October 14, 2020 and Minutes from that meeting for consideration at the Code and Regulation Committee meeting on October 26, 2020. Referred to Code and Regulation Committee.

2. Alderman Thompson-Kelly made a request for a discussion of how the City of Rockford should respond to protesters. Referred to Code and Regulation Committee.

1. Memorandum from Lafakeria Vaughn, Assistant City Attorney, regarding a request for a Fine Reduction for the property located at 4518 Cleveland Avenue reducing the fine from $22,500.00 to a maximum of $750.00.

2. Memorandum from John Pozzi, Police Business Manager, regarding the acceptance of FY 2020, United States Department of Justice, Edward

IV. PUBLIC SPEAKERS

1. Ari Perez of Rockford, Illinois voiced his frustrations with the way he was treated as a protestor outside of City Hall today. He mentioned he was provoked by police officers and indicated excessive force was used during his arrest.

2. John Tac Brantley of Rockford, Illinois shared his concerns regarding students and their families having to quarantine at home because the students didn't want to wear masks at school. Mr. Brantley announced he received approval as a 501c3 organization.

3. Brendan Rabbitt of Rockton, Illinois voiced his concerns regarding an incident that took place at City Market. He also spoke about protesters' rights to Free Speech and gestapo tactics that he believes are being used against the protesters.

4. Skye Garcia was not present.

5. Jodi Williams of Rockford, Illinois indicated she is the President of ATU Local 1333. She spoke regarding the safety of transit drivers and passengers of public transportation. She reported that ten percent of the members of ATU Local 1333 have already tested positive for COVID-19. Ms. Williams indicated they are still transporting up to 32 passengers at one time and some passengers are refusing to wear masks and get off the bus when they are coughing and sneezing. She pleaded with the council members to provide assistance to the drivers and some type of safety restrictions to keep the drivers and passengers safe.

1. 2020-234-CR - Committee recommends approval of the Road Dedication Plat for Brookwood Subdivision.

Alderman Chiarelli, on behalf of the Code and Regulation Committee, read in the committee report. Alderman Beach then moved to amend the committee report to reflect the following change:

Delete the proposed change that would remove the requirement that committee reports be signed by the members. All committee reports would continue to be signed by members of the committees before they are forwarded to council.

Alderman Hervey seconded the motion. MOTION PREVAILED with a roll call vote of 8 to 5 (Aldermen Durkee, Logemann, Tuneberg, Rose and Hanley voted "No" and Alderman Hoffman was absent).

The committee report, as amended, was then placed up for passage by Alderman Chiarelli.

VIII. OFFICERS REPORTS

A. Alderman Rose

Alderman Rose shared the Mel Anderson Slow Roll Event was a great success. He thanked the Northwest Neighbors Association, the financial sponsors and the planning committee for their tremendous hard work and efforts in making this event possible. He reported there were 85 bicycles and 100 helmets given away to children and he shared it was great to see all of the sponsoring organizations and the community come together for this cause.

B. Alderman Thompson-Kelly

Alderman Thompson-Kelly requested a Moment of Silence in honor of former Rockford Mayor John McNamara.

Mayor Pro Tem Logemann then conducted the Moment of Silence.

Alderman Thompson-Kelly thanked the staff of the Rockford Park District for discussing the details of their 2020 Plan with her. She stated the services the Rockford Park District provides has touched every family and organization in this community. Alderman Thompson-Kelly shared her personal feelings regarding the closure of the Riverview Ice House and she thanked the Rockford Park District for listening to the desires of the community and acting upon them.

C. Alderman McNeely

Alderman McNeely thanked Public Works Director Kyle Saunders and Assistant Deputy Chief Whisenand for their assistance with several recent issues in the Thirteenth Ward.

D. Alderman Tuneberg

Alderman Tuneberg voiced his frustrations regarding the most recent restrictions for bars and restaurants. He asked that Dr. Sandra Martell from the Winnebago County Health Department attend a City Council meeting to explain and clarify the restrictions. Alderman Tuneberg encouraged the restaurant and bar owners to stay strong during this difficult time. He shared the owners have his complete support and he would assist them any way he possibly could.

E. Alderman Durkee

Alderman Durkee disagreed with Alderman Thompson-Kelly regarding the Rockford Park District and he stated he still believes the Riverview Ice House needs to remain open.

Alderman Durkee expressed his feelings regarding the validity of the percent of positivity rate being used by the Winnebago County Health Department. He voiced his frustrations and asked that the Director of the Winnebago County Health Department attend a City Council meeting and explain their positivity rate findings and enforcement procedures.

Alderman McNeely indicated last week she spoke with City Administrator Todd Cagnoni and requested that representatives from the Winnebago County Health Department, Rockford Park District and Rockford Public Library come before the council members and answer questions regarding several issues. She then asked City Administrator Cagnoni if he knew when the agencies would be attending a City Council meeting.

City Administrator Cagnoni replied and indicated he reached out to the Executive Director of the Rockford Public Library and he believed the library staff would be present at the committee meetings next week. He informed the aldermen he contacted Dr. Martell from the Winnebago County Health Department and she has agreed to address City Council but no date has been confirmed yet. City Administrator Cagnoni reported the Rockford Park District was presenting their proposed Implementation Plan to the Park District Board next week and that meeting conflicts with the City Council meeting. He indicated he would follow up with the Park District to coordinate a date for them to attend a meeting.

F. Alderman Ervins

Alderman Ervins read a passage of scripture and expressed his thoughts and concerns about seeking wisdom and loving others.

Alderman Ervins spoke about the power of fasting and praying and he asked if a day of fasting and prayer could be established for the City of Rockford.

G. Alderman Frost

Alderman Frost wished City Administration Todd Cagnoni a Happy Birthday. H. Alderman Quinonez

Alderman Quinonez shared his concerns for small businesses, bars and restaurants and he stated he would like a representative from the Winnebago County Health Department to address City Council and answer questions.

Alderman Quinonez inquired who was enforcing the new restrictions that are in place for bars and restaurants.

Legal Director Nicholas Meyer replied and stated for the most part the City of Rockford Code Enforcement, Legal Department and the Community Development staff have been handling the complaints. He reported in the summer, when the restrictions eased up, the Winnebago County Health Department took over enforcement but now that more restrictions have been put into place the City of Rockford staff would resume handling complaints.

Alderman Quinonez then asked Chief O'Shea if the Rockford Police Officers were going out and investigating if bars are open.

Chief O'Shea replied that the Legal Department, Code Enforcement Officers and Community Development staff are handling all complaints and checking businesses at this time. He stated the Rockford Police Officers checked on one business a few months ago but he indicated they are not involved with investigating establishments now.

I. Mayor Pro Tem Logemann

Mayor Pro Tem Logemann extended his sympathies to Mayor McNamara and his family on the passing of his father, John McNamara.

J. Alderman Hervey

Alderman Hervey expressed her heartfelt condolences to the entire McNamara family on the passing of former Rockford Mayor John McNamara.

Alderman Hervey inquired if the City Council would consider discussing a Citizens Review Board who would review and respond to citizen complaints and concerns of excessive force by the Rockford Police Department. She shared her personal feelings about the importance of establishing a board and review process where citizens can feel like their voices are being heard. She asked that this issue be presented to the Code and Regulation Committee for discussion.

Legal Director Nicholas Meyer replied and indicated Mayor McNamara had already asked the Legal Department to look into a Citizens Review Board. He indicated the Legal Department was in the process of reviewing procedures of other communities in the State of Illinois and across the country. He mentioned the review process would take some time but he was planning to present the council members with a good analysis of what the options are and what would work best in this community.

Alderman Thompson-Kelly voiced her concerns about all citizens showing respect to each other and having the right to protest. She then submitted a referral to the Code and Regulation Committee to have a discussion on how the City of Rockford should respond to protesters.

IX. CLOSED SESSION

A. Motion to Convene into Closed Session in order to discuss Pending Litigation and Labor Negotiation Matters

The meeting did not convene into Closed Session.

Alderman Rose moved to adjourn the meeting, seconded by Alderman McNeely. MOTION PREVAILED with a unanimous roll call vote (Alderman Hoffman was absent). The meeting was adjourned at 7:12 p.m.
