City of Loves Park City Council met Aug. 7.

Here are the minutes provided by the council:

Mayor Gregory Jury called the meeting to order at 6:01 p.m.

Alderman Mark Peterson opened the meeting with an invocation, followed by the Pledge of Allegiance.

1. Approve Minutes 07/17/23

The Journal of Proceedings for the regular meeting of July 17, 2023, was approved as submitted by the city clerk on a motion by Alderman Schlensker. Second by Alderman Thompson. 2. Kurt Cutler Retirement

Received a letter of retirement from Kurt Cutler of the Loves Park Police Department, effective September 5, 2023. Placed on file.

3. SEP/Oktoberfest & Fee Waiver Request

Received a Special Event Permit application and fee waiver request from the German Society of Rockford, to hold the annual Oktoberfest on September 30, 2023, at Loves Park City Hall, from 11:00 a.m. to 12:00 midnight. Referred to Alderman Thompson of the Codes and Regulations Committee.

4. SEP/Oktoberfest & Fee Waiver Approved

Alderman Thompson of the Codes and Regulations Committee moved to approve the Special Event Permit application for the German Society of Rockford to hold the annual Oktoberfest on September 30, 2023, at Loves Park City Hall, from 11:00 a.m. to 12:00 midnight. Second by Alderman Schlensker. Motion carried by voice vote.

5. General Fund Bills 08/07/23

Alderman John Jacobson presented the General Fund and all other bills dated August 7, 2023, in the amount of $1,498,953.90, and moved that they be paid. Second by Alderman Thompson. Motion carried. 8 Ayes (Aldermen Allton, Owens, John Jacobson, Little, Pruitt, Thompson, Peterson, Schlensker) 2 Absent (Aldermen Dan Jacobson, Holmes)

6. Water Department Bills 08/07/23

Alderman John Jacobson presented the Water Department bills dated August 7, 2023, in the amount of $323,499.69, and moved that they be paid. Second by Alderman Thompson. Motion carried. 8 Ayes (Aldermen Allton, Owens, John Jacobson, Little, Pruitt, Thompson, Peterson, Schlensker) 2 Absent (Aldermen Dan Jacobson, Holmes)

7. Public Safety Report

Alderman Allton presented the Police Department Report for August 7, 2023; presented the Fire Department Report for August 7, 2023, to be placed on file.

8. Public Works Report

Alderman Schlensker presented the Street Department Reports dated August 7, 2023; presented the Water Department Reports dated August 7, 2023, to be placed on file.

9. Finance & Administrative Committee

Alderman John Jacobson of the Finance and Administration Committee presented the minutes from the committee meeting held on July 17, 2023, to be placed on file.

10. Public Works Committee

Alderman Schlensker of the Public Works Committee presented the minutes from the committee meeting held on July 17, 2023, to be placed on file.

11. Codes & Regs. Committee

Alderman Thompson of the Codes and Regulations Committee presented the minutes from the committee meeting held on June 19, 2023, to be placed on file. He also announced that a committee meeting will be held August 21, 2023 at 5:30 p.m.

12. Community Development Committee

Alderman Pruitt of the Community Development Committee presented the minutes from the committee meeting held on July 10, 2023, to be placed on file.

13. Fire Department To Purchase A Breathing Air Compressor

Alderman John Jacobson presented the following resolution and moved for its adoption: RESOLVED, that by the adoption of this Resolution, the Fire Chief James Hart may purchase the Eagle Baron, CFS Model, Breathing Air Compressor from SCBAS, Inc. located at 403 Peoria Street, Washington, IL 61571 for the purchase price of $66,700.00. This new compressor will be replacing the outdated compressor at Station 2 on Windsor Road. The old compressor is no longer serviceable due to the lack of available parts for a unit of its age. This type of compressor is used to fill the breathing air bottles used by firefighters while performing an interior fire attack within a dangerous environment and is critical to firefighter health and safety. RESOLUTION NO. 23-076

14. Redevelopment Agreement Amendment For East Riverside Farms Inc.

Alderman John Jacobson presented the following resolution authorizing the First Amendment to the Redevelopment Agreement for East Riverside Farms, Inc. WHEREAS, the City of Loves Park (“City”) is a duly organized and existing municipality created under the provisions of the laws of the State of Illinois, and is now operating under the provisions of the Illinois Municipal Code, as supplemented and amended from time to time; and WHEREAS, the City has duly established an Industrial Jobs Recovery Law District known as the “Loves Park Corporate Center Redevelopment Project Area” (“LPCC”) under the provisions of the Industrial Jobs Recovery Law, 65 ILCS 5/11-74.6- 1 et seq.. (“Law”), within which the City has implemented Tax Increment Financing; and WHEREAS, the City is authorized under the provisions of the Law to enter into agreements which are necessary or incidental to the implementation of the redevelopment plan and project for the LPCC; and WHEREAS, on April 6, 2021, the City entered into a Redevelopment Agreement for East Riverside Farms Inc. (the “Agreement”) with North Riverside Partners, L.L.C., an Illinois limited liability company, and East Riverside Farms, Inc., an Illinois corporation (hereinafter the non-municipal entities shall be collectively referred to as “Developer”); and WHEREAS, the Agreement provides for, among other things, the allocation and payment of available non developer property increment for reimbursement of up to $360,000.00 of Developer’s eligible project costs, as defined in the Law, for the Squaw Valley Project and Water Sewer Extension Project, as defined in the Agreement; and WHEREAS, the Agreement contained language disallowing the use of available developer property increment to reimburse Developer for eligible project costs associated with the Squaw Valley Project and Water Sewer Extension Project; and WHEREAS, Developer, having submitted certified evidence of eligible reimbursable costs exceed the $360,000.00 reimbursement limit payable through use of available non-developer property increment, has asked the City to allow $100,000.00 of available developer property increment to be used to reimburse Developer for the Squaw Valley Project and Water Sewer Extension Project. NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF LOVES PARK, COUNTY OF WINNEBAGO AND COUNTY OF BOONE, ILLINOIS, AS FOLLOWS:

15. Amendment To Redevelopment Agreement For East Riverside Farms Inc. (Continued)

1. The above recitals are incorporated herein and made a part hereof.

2. The City hereby approves the execution of the First Amendment to the Agreement by and between the City and Developer in substantially the same form as attached hereto as Exhibit “A”.

3. The Mayor is hereby authorized to sign the First Amendment as well as any other necessary documentation required to finalize the First Amendment.

4. This Resolution shall become effective upon its passage, approval, and publication as provided by law.

RESOLUTION NO. 23-077

16. Purchase New Trane Rooftop Air Conditioning Unit For City Hall

Alderman John Jacobson presented the following resolution and moved for its adoption: RESOLVED, that by the adoption of this Resolution, the Facility Manager is authorized to purchase from Helm Service, one new Trane rooftop air conditioning unit to replace the unit damaged by fire earlier this summer at City Hall. The cost for this purchase is $23,954.00 and includes the unit and installation, the curb adapter, removal of the failed RTU, and all necessary electrical work as outlined in the attached quote. The funds for this purchase shall be drawn from Account No. 01-01-6391 (Self Insurance) and should be substantially reimbursed by our insurer. Second by Alderman Peterson. RESOLUTION NO. 23-078

17. Police Department To Hire 3 New Police Officers

Alderman John Jacobson presented the following resolution and moved for its adoption: RESOLVED, that by the adoption of this Resolution, the Mayor authorizes the Police Chief to hire three Police Officers to fill vacant positions within the Loves Park Police Department. These individuals are the next three eligible candidates on the current Civil Service roster. 1. Luke Schwarze; 2. Timothy Meeker, and 3. Claudia Grenlund. Be it further resolved that the official start date will be Tuesday, August 8, 2023. Wages are set by the current Fraternal Order of Police collective bargaining agreement. Second by Alderman Allton. Motion carried. 8 Ayes (Aldermen Allton, Owens, John Jacobson, Little, Pruitt, Thompson, Peterson, Schlensker) 2 Absent (Aldermen Dan Jacobson, Holmes)

RESOLUTION NO. 23-079

18. Oath Of Office

Police Chief Mike McCammond administered the oath of office to Luke Schwarze, Timothy Meeker, and Claudia Grenlund, to the positions of Loves Park Police Officers, to be effective August 8, 2023.

19. 1st Reading Salary Ordinance

Alderman John Jacobson presented for first reading an ordinance fixing and approving wages, salaries, fees, or compensation for city employees, and moved to waive the reading of the ordinance as all aldermen have been provided copies. Second by Alderman Peterson. Motion carried. 8 Ayes (Aldermen Allton, Owens, John Jacobson, Little, Pruitt, Thompson, Peterson, Schlensker) 2 Absent (Aldermen Dan Jacobson, Holmes) Laid Over

20. 1st Reading Variance For 7126 Thomas Drive

Mayor Jury commented that the Rhythm of the Heart Festival was a success and he thanked city staff, volunteers, and everyone who attended.

Alderman John Jacobson moved that the meeting be adjourned. Second by Alderman Schlensker. Motion carried by voice vote. The meeting was adjourned at 6:17 p.m.
