City of Rockford Code & Regulation Committee met July 29.

Prophet Yusef
Mr. Yusef quoted scripture and spoke about his discontent with the President of the United States
John Tac Brantley
Mr. Brantley quoted scripture and announced that he will be taking some children to Magic Waters on Thursday, August 8th. He thanked all of the people and organizations that help sponsor the children.
Chairman Chiarelli offered condolences to Ald. Venita Hervey in the loss of her brother.
II. COMMITTEE REPORTS
1. Committee recommends sustaining the Liquor and Tobacco Advisory Board's approval for:
a. The Sale of Beer and Wine by the Drink; and
b. The Sale of Packaged Beer and Wine in conjunction with a bakery café in a C-4, Urban Mixed-Use Zoning District at 116 North Madison Street, Suite 118 (Jargal Gendenbaatar dba Crust and Crumbles/Applicant).
Subject to conditions. The Legal Director shall prepare the appropriate ordinance. Scott Capovilla, Zoning and Land Use Administrator reported that this item was previously before the Committee. There were some concerns about the request for packaged liquor sales. He explained that he along with Community and Economic Development Director Karl Franzen, and City Administrator Todd Cagnoni drafted some additional conditions of approval. He reviewed the conditions.
Ald. Thompson-Kelly asked if the applicant intended to sale craft beer only. Mr. Capovilla responded "yes." Chairman Chiarelli asked if there was a definition of "craft beer" in the ordinance. Mr. Capovilla stated that there was not but for purposes of the ordinance, the wording defined by the Brewer's Association will be used.
Ald. Tuneberg thanked Ald. Chiarelli for letting him speak. He thanked everyone involved with this request.
Ald. Chiarelli asked if approval for alcohol was granted, could the alcohol be brought outside into the lobby of the establishment. Assistant City Attorney Lafakeria Vaughn explained that approval would be for the establishment only, unless the City Market organization grants them permission to do so. He explained that per the business plan for this particular business, this is more of a delicatessen
Ald. Hervey commented that in her opinion, packaged liquor sales have become an issue, and suggested that some limitations be put into place for these requests, especially in what is considered to be "unusual types of businesses."
Ald. Tuneberg stated that he is the alderman of the ward and has spoken to the owner of the business. The packaged liquor, if approved, will be sold on a case- by-case basis. He explained that per the business plan, the base customers will consist more of a "wine and cheese" crowd. Ald. Tuneberg went on to explain that the applicant is collaborating with a local downtown brewery, and some of the same yeast used to make the beer will be used in the bread.
Ald. Rose stated that he too previously had some concerns but learned that there are some small town where breweries are located where this is done. He expressed his support.
Ald. Hervey stated that as a Council Member, she does not draw a line whether someone is a part of a wine and cheese crowd or the malt liquor and wings crowd. If approval is granted, the establishment must sell to whomever wants to buy.
Ald. McNeely thanked Chairman Chiarelli for letting her speak. She commented that she agreed with Ald. Hervey's comments. She asked if the Legal Department could put some guidelines together that would be specific to the marketplace concerning packaged sales.
Chairman Chiarelli thanked Staff for reviewing and amending the conditions of approval. Approval is subject to the following conditions:
1. Meet all applicable Building and Fire Codes
2. Compliance with all City of Rockford Liquor Codes
3. The sale of beer and wine by the drink shall be limited to the area as submitted in Exhibit F
4. The hours of operation shall be limited to 7 a.m. to 7 p.m. Tuesday through Thursday
5. The hours of operation shall be limited to 7 a.m. to 9 p.m. Friday
6. The hours of operation shall be limited to 7 a.m. to 7 p.m. Saturday
7. Window display signage is limited to 20% of window area
8. That the windows shall not be covered with bars or other devices that block the windows
9. The bakery cafe shall not have a dance floor
10. The bakery cafe shall not have any DJs
11. The bakery café shall not operate as a nightclub
12. The bakery café shall not have a cover charge
13. As presented within the applicant’s proposal, the proposed use and facility is prohibited from having any video gaming machines
14. All conditions must be met prior to establishment of use
15. Any pending general ordinance case(s) must be resolved prior to issuance of the license
16. All outstanding general ordinance fines must be paid prior to the issuance of the license
17. Sale of packaged beer and wine shall be limited to a minimum of 22 oz. bottles of wine and craft beer sold in containers no less than 22 oz. in size
18. The sale of packaged beer and wine is limited to a shelf or cooler area of no more than four (4) feet in width and six (6) feet in height
19. The sale of alcoholic beverages for consumption off-premises shall never be in principal business of Crust and Crumbles or any successor entity
