1. 18xx, 1850, 1972 McFarland Road, 1965 North Perryville Road
Zoning Board of Appeals recommends denial of a Special Use Permit for a Planned Unit Development consisting of five (5) commercial/retail use buildings, a quick lube oil change service building and a drive-through pick-up window for one of the commercial buildings including freestanding signs with deviations from the regulations, site plan with deviations from the regulations and perimeter landscaping, foundation landscaping, interior landscaping and open green space requirements with deviations from the regulations in a C-2, Limited Commercial Zoning District at 18xx, 1850, 1972 McFarland Road, 1965 North Perryville Road (Sunil Puri, LLC and Perryville Development Corp/Applicants)
Todd Cagnoni, City Administrator for the City of Rockford explained that Staff's recommends that this item be referred back to the Zoning Board of Appeals. Staff has determined that the letters that were sent to the adjacent property owners omitted Leeland Subdivision and Red Oak Subdivision, which are adjacent to the overall development. He noted that the applicant had indicated adjacent property owners, in several instances that included notification to themselves. Although that is consistent with state statute, as well as the City of Rockford Zoning Ordinance, Staff's past practice has been to notify adjacent property owners beyond the developer's ownership to allow for full public participation. Mr. Cagnoni explained that if approved, the item would be back before the Zoning Board on March 17th, and would then appear back on the Code & Regulation Committee Agenda on March 23rd.
Ald. Hervey asked if sending the item back to ZBA would have any impact on the developer's timeline with their tenants. Attorney Marvin Keyes, a representative for First Midwest Group was allowed to speak. He stated that while sending the request back to ZBA would hinder the progress, First Midwest Group does understand the reasoning for the recommendation, and they are prepared to do whatever is necessary.
Ald. Quinonez asked if the proposal had changed in any way. Attorney Keyes indicated that the applicant had made several modifications since the matter was previously before ZBA.
Chairman Chiarelli noted that the applicant had recently submitted a new site plan.
Ald. Hervey asked about the location of the subdivisions, and wanted to know if it were possible to continue to move this matter forward while notifying the adjacent property owners simultaneously. Mr. Cagnoni stated that the properties in question are one (1) lot away from the planned unit development. He explained that continuing to move the item forward would not change the timeframe. If approved, Staff will send out letters to the subject adjacent property owners tomorrow notifying them of the March 17th ZBA meeting to stay in line with the ten (10) day notice rule.
