Village of Cherry Valley Board of Trustees met Dec. 17.

Here is the minutes provided by the board:

PRESIDENT JIM E. CLAEYSSEN CALLED THE VILLAGE BOARD MEETING TO ORDER AT 7:00 PM AND LED THE PLEDGE OF ALLEGIANCE.

A roll call was taken by Village Clerk Kathy Trimble:

NANCY BELT PRESENT SALLY HOLLEMBEAK PRESENT

JEFF FUSTIN PRESENT JEFF O’HARA PRESENT

DAVID SCHROEDER ABSENT

Also present: Attorney Jim Stevens, Treasurer Maureen Gumowski, Police Chief Robert Swank, and Village Clerk Kathy Trimble.

ADOPTION OF THE AGENDA:

Trustee Fustin moved to adopt the agenda. Trustee O’Hara seconded. All “Aye;” none opposed. Motion carried by voice vote.

APPROVAL OF THE VILLAGE BOARD MINUTES:

Trustee Fustin moved to approve the December 2, 2019 Village Board Minutes. Trustee O’Hara seconded. Motion carried with 3 “Aye” and 1 ABSTAIN voice vote.

PUBLIC COMMENT:

Mr. Bill Lawson, President of the Newburg Village Home Owners Association, residing at 283 Fairway View, Belvidere, IL 61008. Mr. Lawson thanked the Village Board for the Driveway Variance for 7179 West Ridge Lane. Mr., Lawson stated that there are approximately 20% of the homes in the Newburg Village Subdivision that are not in compliance with Village Ordinance 2006-17 regarding the width of driveways of 21’ at the property line and 27’ at the public street since they were built prior to 2006. Mr. Lawson has proposed that the Village change the Ordinance to state that homes built after January 1, 2020 have to comply with Ordinance 2006-17 and homes built prior to January 1, 2020 can replace their existing driveways using the same dimensions of the pre-existing driveway.

TREASURER’S REPORT: No Report.

PRESIDENT’S REPORT:

1. Trustee Fustin moved that the Village Board approve a revised Inter-Governmental Agreement (IGA) for 2020 with Cherry Valley Township for providing Road Services for 2020. Trustee Hollembeak seconded. A roll call vote was taken:

Motion carried 4-0.

2. Trustee Hollembeak moved that the Village Board approve a Class “L” Liquor License and Gaming Application for Kelly Williams Mobil Co. dba CherryVale Mobil, 1736 Perryville Road, Rockford, IL. for the remainder of Fiscal Year 2019-2020. Trustee Belt seconded. A roll call vote was taken:

JEFF FUSTIN AYE JEFF O’HARA AYE

Motion carried 4-0.

ATTORNEY’S REPORT: JIM STEVENS: No Report.

ENGINEER’S REPORT: DENNIS MCMULLEN, C.E.S. - No Report.

EX-OFFICIO’S REPORTS:

JEFF FUSTIN – PLANNING AND ZONING COMMISSION:

Trustee Fustin stated that the December Planning & Zoning Meeting has been cancelled and we will wait and see if we receive anything for the January Meeting.

PRESIDENT CLAEYSSEN FOR DAVID SCHROEDER – RECREATION BOARD:

President Claeyssen stated that at the December 11, 2019 Recreation Board Meeting they chose five (5) Homes to be the Holiday Light Winners. The winners will be listed in our next Newsletter. The next Recreation Board Meeting will be January 8, 2020 at 7:00PM, everyone is invited to attend.

ORDINANCE REPORT BY TRUSTEE NANCY BELT:

1. Trustee Belt moved that the Village Board consider this the second and final reading of “An Ordinance Amending Chapter 26 – Businesses of The Village of Cherry Valley Code of Ordinances, to Prohibit Adult-Use Cannabis Business Establishments Within the Village of Cherry Valley”. Trustee Hollembeak seconded. Trustee Fustin would like to table this Ordinance since Trustee Schroeder is not present and possibly put a moratorium in place until we can have additional information. Trustee Belt would like to move forward with the Ordinance as it is written for passage. Attorney Stevens stated that a motion to table the ordinance supersedes the current motion before the Village Board. Trustee Hollembeak moved to table this Ordinance to the next Committee of the Whole Meeting in January 2020. Trustee O’Hara seconded. A roll call vote was taken:

Motion carried with 3 “AYES” and 1 “NAY”

2. Motion that the Village Board pass and approve Ordinance 2019-21 “An Ordinance Amending Chapter 26 – Businesses of The Village of Cherry Valley Code of Ordinances, to Prohibit Adult-Use Cannabis Business Establishments Within the Village of Cherry Valley”. This Ordinance was tabled to the January 13, 2020 Committee of the Whole Meeting.

3. Trustee Belt moved that the Village Board consider this the first reading of “An Ordinance Granting A Variance Under Section 82-55 to Ordinance No. 2006-17 to Allow and Ratify the Construction of a Driveway 23 Feet in Width at the Western Property Line Pursuant to The Code of Ordinances for The Village of Cherry Valley, Illinois”. (7179 West Ridge Lane, Cherry Valley, Illinois). Trustee Hollembeak seconded. All “Aye;” none opposed. Motion carried by voice vote.

Trustee BELT stated that ORDINANCE passes.

FINANCE REPORT BY TRUSTEE JEFF O’HARA:

1. Trustee O’Hara moved that the Village Board approve the bills reviewed and approved by the Budget Director on December 17, 2019 and reviewed and approved by the village trustees present at the December 17, 2019 Village Board Meeting at a total cost of $164,789.20. Trustee Hollembeak seconded. A roll call vote was taken:

Motion carried 4-0.

2. Treasurer Maureen Gumowski gave the Monthly Administration Department Progress Report for November 2019. The Report will be placed on file.

Trustee O’Hara stated that FINANCE passes.

PUBLIC SAFETY REPORT BY TRUSTEE JEFF FUSTIN:

Trustee Fustin referred to Police Chief Swank for the Public Safety Report. Chief Swank gave an update on the Regional SWAT Team. Chief Swank stated that the Police Officers that were interested in the Regional SWAT Team have withdrawn their requests, therefore at this time we will not be exploring this program.

PUBLIC WORKS REPORT BY TRUSTEE JEFF O’HARA FOR TRUSTEE DAVID SCHROEDER:

1. Trustee O’Hara moved to approve the donation of White Pines Trees from Mr. Doug Weir with an associated transplanting cost of $2,500.00 (5 Trees) from line item 5405 Water (2020-21 Budget). Trustee Fustin seconded. Discussion was had regarding the possible location of the trees and if they were healthy trees. After further discussion a roll call vote was taken:

Motion carried 4-0.

2. The Public Works Overtime Report will be placed on file.

3. Public Works Director prepared a list of Project Updates that were passed out to the Trustees. Trustee O’HARA stated PUBLIC WORKS passes.

PLANNING AND DEVELOPMENT REPORT BY TRUSTEE DAVID SCHROEDER: No Report.

PERSONNEL REPORT BY TRUSTEE SALLY HOLLEMBEAK:

1. The Monthly Health Insurance Report will be placed on file.

Trustee HOLLEMBEAK stated PERSONNEL passes.

BOARD COMMENTS:

ADJOURNMENT: Trustee Hollembeak made a motion to adjourn the meeting; seconded by Trustee Belt. All “Aye”, none opposed. Meeting adjourned at 7:27 PM.
