I. CALL TO ORDER 

Mayor McNamara called the meeting to order at 5:39 p.m.

Mayor McNamara thanked the Salvation Army Band and Alderman Beach for providing the festive Christmas music.

C. Acceptance of the Journal 

1. Journal of Proceedings for the City Council meeting held on November 21, 2022. 

Alderman Beach moved to accept the Journal of Proceedings for the City Council meeting held on November 21, 2022, seconded by Alderman Torina. MOTION PREVAILED with a unanimous voice vote (Aldermen Durkee, Logemann, Prunty, Meeks and McNeely were absent).

2. Journal of Proceedings for the Special City Council meeting held on December 12, 2022. 

Alderman Beach moved to accept the Journal of Proceedings for the Special City Council meeting held on December 12, 2022, seconded by Alderman Torina. MOTION PREVAILED with a unanimous voice vote (Aldermen Durkee, Logemann, Prunty, Meeks and McNeely were absent).

II. PROCLAMATIONS 

There were no proclamations presented at this meeting.

III. PUBLIC HEARINGS 

1. Public Hearing for the proposed Right-of-Way Vacation for the area between 909 North Prospect Street and 1700 Rural Street south of 909 North Prospect Street.

Mayor McNamara called upon Alderman Torina to conduct the Public Hearing. Alderman Rose called the Public Hearing to order at 5:42 p.m. pursuant to 65 Illinois Compiled Statues 5/11-91-1, for the proposed Right-of-Way Vacation for the area between 909 North Prospect Street and 1700 Rural Street south of 909 North Prospect Street.

Alderman Torina indicated a notice of this hearing was given by publication in the Rockford Register Star on December 4, 2022. That notice informed citizens of Rockford that the Rockford City Council would hold a Public Hearing on Monday, December 19, 2022 at 5:30 p.m. in Council Chambers on the 2nd floor, at Rockford City Hall, located at 425 E. State Street, Rockford, Illinois for the consideration of a proposed right-of-way vacation of the area between 909 North Prospect Street and 1700 Rural Street south of 909 North Prospect Street, also known as unimproved Brownwood Road.

Alderman Torina asked for questions or comments from the council members and the general public with regard to the proposed right-of-way vacation. Legal Director Nicholas Meyer clarified the date of the public hearing was December 19, 2022. Hearing none, the Public Hearing was adjourned at 5:44 p.m.

RESULT: DISCUSSED

Alderman Torina called the Public Hearing to order at 5:45 p.m. pursuant to 65 Illinois Compiled Statues 5/11-91-1, for the proposed right-of-way vacation for the right of way adjacent to 602 S. Pierpont Avenue known as the north/south paper alley of 7XX Waveland Avenue.

Alderman Torina indicated a notice of this hearing was given by publication in the Rockford Register Star on December 4, 2022. That notice informed citizens of Rockford that the Rockford City Council would hold a Public Hearing on Monday, December 19, 2022 at 5:30 p.m. in Council Chambers on the 2nd floor, at Rockford City Hall, located at 425 E. V. PUBLIC SPEAKERS 

1. Pat Kenney spoke about the importance and many unique qualities of Bell Bowl Prairie and she urged the council members to help save the prairie.

2. Laura Stamp spoke against the Rockford Airport expansion as it is currently and against the destruction of the Bell Bowl Prairie. She expressed her desire for the airport to redesign the expansion or use an alternative plan that has already been prepared that protects the prairie.

3. Yolanda Green shared her desire to work with city staff to improve neighborhoods and to facilitate solutions to issues the City of Rockford was currently facing.

4. Martin Quirk expressed his support for backyard hens and he encouraged the council members to vote in favor of the ordinance. He spoke about the benefits of backyard chickens and about compromise.

5. Nancy Gdowski voiced her concerns about backyard chickens being allowed in neighborhoods in the City of Rockford and the negative impact this could have on neighborhoods. She encouraged the council members to vote against the ordinance.

B. Code and Regulation Committee 

1. 2022-299-CR - Committee has no recommendation on the Liquor and Tobacco Advisory Board's approval for a Modification of an existing Class A liquor license to a Class L50 and to add video gaming terminals in conjunction with a restaurant in a C-4, Urban Mixed-Use Zoning District at 501 East State Street (Matt Idzikowski/Vintage @ 501 LTD dba Vintage @501/Applicant).

Alderman Torina, on behalf of the Code and Regulation Committee, read in the committee report and placed it up for passage.

Alderman Bonne then made a motion to amend the committee report to reflect the following change: Modifying the Liquor and Tobacco Advisory Board's recommendation to approve a modification of the liquor license at Vintage 501 (501 E. State Street) to add three (3) gaming machines, rather than five (5).

Alderman Tuneberg seconded the motion. MOTION PREVAILED with a voice vote of 11 to 1 (Alderman Torina voted "No" and Aldermen Meeks and McNeely were absent).

The committee report, as amended, was then placed up for passage.

2. 2022-300-CR - Committee has no recommendation on the Modification of an existing Liquor License to add one additional Video Gaming Terminal at Screw City Tavern located at 4412 Manchester Drive.

Alderman Torina, on behalf of the Code and Regulation Committee, read in the committee report and placed it up for passage.

Alderman Bonne then made a motion to amend the committee report to reflect the following change:

Approval of a modification of the liquor license for Screw City Tavern (4412 Manchester Drive) to add one (1) gaming machine.

Alderman Quinonez seconded the motion. MOTION PREVAILED with a roll call vote of 7 to 5 (Aldermen Durkee, Torina, Prunty, Wilkins and Beach voted "No" and Aldermen Meeks and McNeely were absent).

The committee report, as amended, was then placed up for passage.

4. Committee recommends approval of an Amendment to the City of Rockford Code of Ordinances to allow hens at single-family homes in the City of Rockford. The Legal Director shall prepare the appropriate ordinance.

Alderman Torina, on behalf of the Code and Regulation Committee, read in the committee report and placed it up for passage. 

Alderman Rose then made a motion to amend the committee report to reflect the following changes:

The proposed ordinance shall state that:

1) The hen ordinance is a city-wide Pilot Program that shall expire 12 months from the date of adoption by council; and

2) The City shall not issue more than 30 permits.

Alderman Rose also stated City staff is further directed to report to the Code and Regulation Committee 12 months after passage of the ordinance. The report shall include the number of permits issued and the number of ordinance violations reported.

Alderman Rose expressed his support for this ordinance and he shared comments from three letters from members in the community that were in favor of allowing backyard chickens in the City of Rockford.

Alderman Torina then seconded the motion.

The council members discussed this item at length and then the MOTION PREVAILED with a roll call vote of 8 to 4 (Aldermen Tuneberg, Prunty, Hoffman and Beach voted "No" and Aldermen Meeks and McNeely were absent).

Alderman Frost then made a motion to lay this item over, seconded by Alderman Quinonez. The item was then laid over.

5. 2022-301-CR - Committee recommends approval of the request to amend the Right-of-Way Vacation Ordinance for 909 North Prospect previously approved by Council and to vacate the Right-of-Way known as unimproved Brownwood Road for the total cost of $500.00. The Legal Director shall prepare the appropriate ordinance.

Alderman Torina, on behalf of the Code and Regulation Committee, read in the committee report and placed it up for passage.

VII. OFFICERS REPORTS 

A. Alderman Tuneberg 

Alderman Tuneberg announced on Wednesday, December 21st at 3:00 p.m. there would be Winter Solstice Poetry Caroling at Walker Park for all ages.

B. Alderman Bonne 

Alderman Bonne thanked Mayor McNamara and city staff for unveiling the Give Better campaign which encourages citizens to contribute to local charities that work to end homelessness. He shared his hopes that this campaign would assist with decreasing the number of panhandlers standing at intersections.

C. Alderman Rose 

Alderman Rose mentioned the forecast was predicting severe weather later in the week and he urged citizens to get prepared ahead of time and to check in on their neighbors.

D. Mayor McNamara 

Mayor McNamara announced a Blue Christmas Service would be held on Thursday, December 22nd at noon at United Methodist Church located at 1404 Brooke Road. He mentioned the service was to honor and pay tribute to all the lives lost due to the opioid epidemic.

1. 2022-287-R - Committee recommends approval of the Contract Renewal - Medical Stop Loss 2023 to Tokio Marine HCC, of Houston, Texas for a contract amount/rates $22.70 per employee per month - Single Enrollment and $77.31 per employee per month - Family Enrollment. The total estimated annual premium is $864,692 based on current number of health insurance participants. The contract duration is one (1) year. The funding source is the Health Insurance Fund.

(ESI), of St. Louis, Missouri for a contract amount/rates: expenses are based on Average Wholesale Price (AWP), less a discount. Retail Cost of Brand Name Drugs will be AWP less 19.50%, Generic drugs will be AWP less 83%. Greater discounts will be applied for mail order. These new rates represent approximately a $275,000 savings. The total estimated cost is $4.5 million. The contract duration is one (1) year with two (2) additional single year renewal options.
