A. Financial Discussion - August 2023

Director Hagerty stated that the trend continues, revenues are 11% over budget year-to-date or $13,600,000, which is largely driven by replacement tax. The Illinois Department of Revenue (IDOR) does not expect the trend to continue. For expenses, we are $8.7 million under budget mainly due to under budget staffing as well as delays in capital equipment purchases. Overtime in both police and fire is significantly over budget. For CIP sales tax, is over budget by approximately $1.2 million, but motor fuel tax is under budget by $600,000. The redevelopment fund is performing well, $600,000 over budget.

B. 2023-230-CR - Approval of the City-State Railroad Agreement for Railway Highway Grade Crossing Improvements (School Street & Canadian Pacific Railroad Tracks (CPRR) using Illinois Commerce Commission (ICC) Grade Crossing Protection Funds (GCPF). This agreement outlines the funding of this estimated $191,727.00 project. The project shall be 100% covered by Grade Crossing Protection Funds (GCPF), with no cost to the City. The Legal Director shall prepare the appropriate ordinance.

Ald. Tuneberg thanked Tim Hinkens for his efforts for the City-State Railroad Agreement.

C. 2023-231-CR - Approval of the Purchase Agreement between the City of Rockford and Oliver Emerson Development, LLC for the purchase of the building at 215 South Madison Street (Watch Factory) for $55,000.00, which is the appraised value of the property. The sale of the property is necessary to provide site control that will allow the private developer to invest in completed market studies, engineering, architectural services and secure redevelopment financing. The Legal Director shall prepare the appropriate ordinance.

Ald. Beach questioned the cost to the City. Director Franzen stated at this time it is a purchasing agreement, which will include a development agreement. It is a significantly larger square foot redevelopment cost than other properties so there is a $1.2 million subsidy on top of that. The agreement will come before council, nothing binds us to the redevelopment agreement.

F. Approval of the release of Lien for 307 North Hinkley Avenue for a total amount of $2,909.00. The owner has now sold the property through a warranty deed, which means she is responsible for resolving all of the liens. The proceeds of the sale have been held in escrow pending a lien release from the City. The liens, however are very old (dating back to 1980) and the City has not incurred any expenses on the property since 1994. The Legal Director shall prepare the appropriate ordinance.

Ald. Frost asked what the property sold for. Director Meyer stated the property sold for $80,000. The owner’s parents took title to the property in 1995 through a quitclaim deed. The purchaser was unaware of the liens when they took title of the property. The owner has since passed away and the daughter is requesting a release of the liens. In these circumstances with a quitclaim deed it is the buyer’s responsibility to take care of the liens.
