City of Loves Park City Council met April 1.

Here are the minutes provided by the council:

Mayor Gregory Jury called the meeting to order at 6:00 p.m.

City Treasurer John Danielson opened the meeting with an invocation, followed by the Pledge of Allegiance.

1. APPROVAL OF CITY COUNCIL MINUTES

The Journal of Proceedings for the regular meeting of March 18, 2024, was approved as submitted by the City Clerk on a motion by Alderman Schlensker. Second by Alderman Allton. Motion carried. 9 Ayes (Aldermen Peterson, Holmes, Schlensker, Allton, Owens, Little, Dan Jacobson, Pruitt, Thompson) 1 Absent (Alderman John Jacobson)

2. COMMUNICATIONS, MAYOR’S REPORT & ANNOUNCEMENTS

SEP ROCK RIVER MULTISPORT DUATHLON

Received a Special Event Permit application from Rock River Multisport to hold a Duathlon on a portion of Loves Park streets on Sunday, July 21, 2024, from 6:00 a.m. to 11:00 a.m. Referred to Alderman Thompson of the Codes and Regulations Committee.

3. LETTER OF RESIGNATION

Received a letter of resignation from Loves Park Police Officer Tyler Baird, Effective March 29, 2024. Placed on file.

4. COM-ED CONFERENCES

Received notices of pre-hearing conferences regarding Commonwealth Edison Company, to be held April 7, and April 10, 2024, via WebEx. Placed on file.

5. YARD WASTE PICKUP

Mayor Jury announced that yard waste pickup will begin Friday, April 5, 2024.

Alderman Peterson presented the General Fund and all other bills dated April 1, 2024, in the amount of $1,111,794.85, and moved that they be paid. Second by Alderman Pruitt. 7. WATER FUND BILLS

Alderman Peterson presented the Water Department bills dated April 1, 2024, in the amount of $80,507.13, and moved that they be paid. Second by Alderman Pruitt. Alderman Allton presented the Police Department Report for April 1, 2024; presented the Fire Department Report for April 1, 2024, to be placed on file.

Alderman Schlensker presented the Street Department Report for April 1, 2024; presented the Water Department Report for April 1, 2024, to be placed on file.

FINANCE & ADMINISTRATION COMMITTEE

Alderman Peterson of the Finance and Administration Committee presented the minutes from the committee meeting held on March 18, 2024, to be placed on file.

11. PUBLIC WORKS COMMITTEE

Alderman Schlensker of the Public Works Committee presented the minutes from the committee meeting held on March 18, 2024, to be placed on file.

12. CODES AND REGULATIONS COMMITTEE

Alderman Thompson of the Codes and Regulations Committee presented the minutes from the committee meeting held on March 4, 2024, to be placed on file. He also announced that a committee meeting will be held on Monday, April 15, 2024 at 5:25 p.m.

13. COMMUNITY DEVELOPMENT COMMITTEE

Alderman Pruitt of the Community Development Committee presented the minutes from the committee meeting held on March 4, 2024, to be placed on file.

14. RESOLUTIONS & MOTIONS

ARCDESIGN RESOURCES HIRED FOR RECONSTRUCTION OF LANTERNE DRIVE Alderman Schlensker presented the following resolution and moved for its adoption: RESOLVED, that the Street Department Manager is authorized to hire ArcDesign Resources, 5291 Zenith Parkway, Loves Park, IL 61111 for professional civil engineering services for Lanterne Drive from east of Meadowview Circle where full curb section stops (1,325 feet) for reconstruction with two options. First option is to rebuild the street from a ditch section to curb and gutter, storm water and sidewalks. Second option is to regrade the ditches, replace driveway culverts and driveways as needed. At a cost not to exceed forty-five thousand one hundred dollars ($45,100.00). The scope of work is defined on the attached “Agreement for Services”. Funds shall be taken from Account No. 01-11-8035 (Road Repair and Infrastructure). Second by Alderman Peterson. RESOLUTION NO. 24-027

15. COUNTRYMAN INC. HIRED TO RE-STRIPE VARIOUS ROADS IN THE CITY Alderman Schlensker presented the following resolution and moved for its adoption: RESOLVED, that the Public Works Manager is authorized to hire Countryman Inc., P.O. Box 1364, Rockford, IL 61105 to re-stripe various roads within the City. Total cost of the contract shall not exceed forty thousand dollars ($40,000.00). Funds shall be taken from Account No. 01-11-8102 (Street Paint). Second by Alderman Peterson. Motion carried. 9 Ayes (Aldermen Peterson, Holmes, Schlensker, Allton, Owens, Little, Dan Jacobson, Pruitt, Thompson) 1 Absent (Alderman John Jacobson)

RESOLUTION NO. 24-028

16. TEMPORARY SEASONAL EMPLOYEES TO BE HIRED

Alderman Schlensker presented the following resolution and moved for its adoption: RESOLVED, that the Street Department Manager is hereby authorized to hire temporary seasonal employees within the Department of Public Works. Employment shall not exceed eight (8) and shall be for a period of May 1, 2024 through April 30, 2025. A wage rate of $14.00 to $18.00 per hour, depending upon experience, shall be drawn from Street Department Account No. 01-11-8012. Second by Alderman Peterson. Motion carried. 8 Ayes (Aldermen Peterson, Holmes, Schlensker, Allton, Owens, Little, Dan Jacobson, Pruitt) 1 Abstain (Alderman Thompson) 1 Absent (Alderman John Jacobson)

RESOLUTION NO. 24-029

17. POLICE CHIEF’S SALARY AMENDED FOR HUMAN RESOURCES SERVICES Alderman Peterson presented the following resolution amending the Salary Ordinance to provide for compensation for Human Resources Services to be provided by the Police Chief and to revise the Job Description of the Police Chief to include Human Resources.

WHEREAS, the Corporate Authorities have determined that it is in the best interests of the community to consolidate supervision of human resources throughout all City departments to promote consistency of policies and procedures; and

WHEREAS, Police Chief Michael McCammond currently oversees the human resources policy development and implementation in the Police Department which employs approximately one-half of all City employees; and

WHEREAS, as a result of his work in the Police Department, Chief McCammond has shown that he has the necessary knowledge, organization, and management skills to provide human resources oversight for all City Departments; and

WHEREAS, the City wishes to adopt the attached revised job description for the duties of the Police Chief in order to incorporate City-wide human resources responsibilities and the City further wishes to provide Chief McCammond additional compensation for the added duties required of him; and

WHEREAS, the current responsibilities of other department heads relating to human resources activities are not affected by this oversight role, but such department heads shall coordinate with Chief McCammond who is charged with creating a more uniform structure across all departments.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and the City Council of the City of Loves Park, County of Winnebago and County of Boone, Illinois, that by the adoption of this resolution, that the Mayor and the City Council hereby agree as follows:

1. The above recitals are hereby incorporated into this Resolution as if fully stated herein.

2. The attached revised job description for the Chief of Police is adopted and additional compensation for the enhanced duties in the amount of $20,000.00 per year is ratified and approved as of the passage of this Resolution with such amount to be pro-rated for the remainder of the current fiscal year.

3. In the event that Chief McCammond or any future chief does not perform the additional human resources functions relating to other departments of the City, the additional compensation and any accretion thereof will be terminated, and the job description will be revised accordingly.

4. Funds for this increase shall be drawn from Account No. 01-13-9000 (Salary of Police Chief). 5. This Resolution shall be in full force and effect from and after its passage and approval. Second by Alderman Pruitt. 18. CITY’S SPECIAL PROSECUTOR TO SEEK TRADEMARK REGISTRATION OF RHYTHM OF THE HEART FESTIVAL

Alderman Peterson presented the following resolution authorizing the Mayor to instruct the City’s Special Prosecutor to seek trademark registration of the name Rhythm of the Heart Festival.

WHEREAS, the City of Loves Park (“City”) is a duly organized and existing municipality created under the provisions of the laws of the State of Illinois, and is now operating under the provisions of the Illinois Municipal Code, as supplemented and amended from time to time; and

WHEREAS, the City has for the past two years operated a festival for the enjoyment of its Citizens and the region in general, billed as the “Rhythm of the Heart Festival”; and

WHEREAS, due to the success of the festival, the City wishes to secure the name and associated rights for the continuation of the Rhythm of the Heart Festival; and

WHEREAS, THE City’s existing Special Prosecutor is knowledgeable in the process for securing trademark registration.

NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Loves Park, Illinois, that by the adoption of this resolution, that the City hereby agrees:

1. The above recitals are hereby incorporated into this Resolution as if fully state herein.

2. The City Council hereby approves the Mayor making direction to the City’s Special Prosecutor to file the appropriate trademark application with the United States Patent and Trademark Office and otherwise take all those steps necessary in order to pursue the federal registration of a standard character word mark and/or a design mark for the service mark “Rhythm of the Heart Music Festival”.

3. This Resolution will be in full force and effect from and after its passage, approval, and publication in pamphlet form in the manner provided by law. Second by Alderman Pruitt.
