Illinois governor signs SB 328; critics warn of potential lawsuit surge

Governor JB Pritzker has signed Senate Bill 328 into law, a move that has prompted criticism from Republican lawmakers, business leaders, and watchdog groups. The law permits any individual in the United States to file a lawsuit against any business registered in Illinois, regardless of whether the dispute is connected to the state.

Critics argue that this change could lead to an increase in lawsuits from outside Illinois, potentially overwhelming the state’s court system and causing delays for residents seeking justice. Business groups have also expressed concern that the new law may discourage investment in Illinois.

The bill was passed during the final hours of the spring legislative session after Democrats employed a “gut and replace” tactic, which allowed them to bypass standard legislative procedures. Republican leaders claim this approach violated the Illinois Constitution’s Three Readings Rule. In response, Senate and House Republicans have filed a lawsuit challenging how the law was enacted and have stated their intent to continue efforts to protect families in Illinois.

State Senator Dave Syverson commented on the legislation: "This law is a prime example of how special interests are being put ahead of the people of Illinois. He says the results of this new law will be higher costs, fewer jobs, and fewer opportunities for hardworking Illinois families."

Syverson has represented Illinois’ 35th Senate District since his election to the State Senate in 1993, following Christine J. Johnson.
