Dave Vella introduced HB1058 in the Illinois House on Jan. 9, 2025, during the general assembly session 104, according to the Illinois General Assembly.

According to the Illinois General Assembly site, the legislature summarized the bill's official text as follows: "Amends the Prevailing Wage Act. Provides that all penalties imposed shall be remitted to the Department of Labor and shall be used for the administration and enforcement of the Act."

The following is our breakdown, based on the actual bill text, and may include interpretation to clarify its provisions.

In essence, the bill amends the Prevailing Wage Act to specify that all penalties imposed under the Act are to be remitted to the Illinois Department of Labor for use in administering and enforcing the Act. It reinforces the requirement that no public works projects can commence without compliance with the Act's provisions, except for federal projects requiring a separate prevailing wage determination by the U.S. Secretary of Labor. The Illinois Department of Labor, via the Attorney General, can seek injunctive relief to halt projects violating wage requirements. Contracts awarded without meeting prevailing wage standards are considered void, and contractors cannot claim damages but may seek reimbursement for labor and materials. The bill also addresses underpayment issues, providing a right of action for affected workers and establishing penalties for contractors, including additional liabilities for repeat offenses. The effective date is not specified in the bill text.

Dave Vella has proposed another eight bills since the beginning of the 104th session.

Vella graduated from Augustana College with a BA and again in 1997 from Northern Illinois University with a JD.

Dave Vella is currently serving in the Illinois State House, representing the state's 68th House District. He replaced previous state representative John M. Cabello in 2021.

Bills in Illinois follow a multi-step legislative process, beginning with introduction in either the House or Senate, followed by committee review, floor debates, and votes in both chambers before reaching the governor for approval or veto. The General Assembly operates on a biennial schedule, and while typically thousands of bills are introduced each session, only a fraction successfully pass through the process to become law.
